Student Learner Agreement:

This Learner Agreement forms part of the general terms and conditions of the Archaeological Divers Association.  Students agree to abide by the following Learners Agreement which shows that they agree to the following terms and conditions. It is very important that you understand and agree to these conditions before you enrol on any ADA or Diver training course.  By enrolling for any ADA Course, or recognised diver training agency course with the ADA you are confirming that in deciding upon your choice of learning programme, you have considered the implications of the following:
  • Cost
  • Time
  • Commitment
  • Organisation
  • Ability
  • Potential
  • Career Direction
You will receive advice and guidance on learning programme choice and are satisfied that the learning programme is suitable for your needs and abilities;

You will undertake to inform the ADA immediately of any changes in your circumstances that may affect your course status;

You will complete and submit all work, including homework, and undertake additional learning support, key skills etc. as required in order to complete your learning objectives;

You understand the entry requirements of your chosen programme and the necessity for Initial Assessment for all courses and designated part time provision.  Where Initial Assessment or other results indicate that you are not suited to your course of choice, ADA reserves the right to transfer you to an alternative course or to ask you to leave the course if no suitable alternatives exist or can be agreed;

In the event of a student being asked to leave a course, you will be refunded the course fee, less a 50% administration charge for the course in question, less costs of training all ready provided at a pro-rota rate;

In the event of a student removing themselves from the course for whatever reason, the ADA is not liable for refunding of the course fees if the course has already started. If the course has not yet started the student will be charged the following administration fees (% of Course Fees):
  • Less than 48 hours 90%
  • Up to 2 weeks prior to course 75%
  • 2 weeks to 1 month prior to course 50%
  • Greater than 1 month 25%
The ADA will always work for a positive outcome for students, and if individuals fall ill, or have other personal and family commitments that render them unable to attend, or need to remove themselves from the course, we will always seek an amicable solution such as transferring the student to the next available date, or placing training on hold. This will only be completed if the student discloses such information at the time and wishes to continue with training at a later date. Such instances of compassionate removal will NOT incur an administration fee;

You understand that all course fees quoted, including those agreed at a discounted rate as well as those on the websites, are the fees which apply to students who are over 16 years of age and who have been resident in the EU for the past 3 years or longer, for purposes other than study;

You understand that there is no automatic entitlement to any financial support and that no decision as to entitlement can be determined until after you have made a formal application to the ADA;

Some learners may be required to pay a higher fee rate than the rate normally quoted to enquirers. Alternatively, some Learners may be eligible for fee concessions, dependent upon individual circumstances and/or the particular course enrolled upon;

Where Learners have misrepresented their entitlement to a particular fee rate, either intentionally or unintentionally, or have failed to provide appropriate/adequate information (“prior to” or at the “point of” enrolment), ADA reserves the right to subsequently charge the correct fee rate and/or to exclude any learners from course provision who have not paid the correct fee;

Some course will include an examination fee, registration fee and/or assessment fee. These fees may need to be paid at the same time as the course fees, when you register for the course. The ADA expects that you will enter for all examinations related to the course(s) for which you are enrolled.  Payment of examination fees does not automatically guarantee entry for the examination, this is at the discretion of the ADA Instructor and Chief Executive;

You understand that the ADA may need to contact yourself; your next of kin; your employer or other fee sponsoring body with regard to issues such as attendance, conduct, progress etc. Such communication may be via telephone, letter, fax, email, sms or any other appropriate means;

You are advised that because circumstances change, ADA accepts no liability for the accuracy or otherwise of statements appearing in course materials nor will the ADA be responsible for any detriment suffered in reliance on them e.g. you should check with any Institution that you wish to progress onto that the programme you intend to follow at ADA meets their specific entry requirements;

In purchasing any course you are also accepting that the ADA may not be able to provide the services or programmes outlined in course materials in a range of circumstances, including: low class numbers, long-term illness of specialist staff; industrial action; severe weather conditions; severe damage to buildings; any circumstances which may affect the Health and Safety of Staff or Students. In such circumstances the ADA reserve the right to withdraw any programme or service and offer a refund if appropriate or another date for the course you have enroled;

When purchasing training packages from the ADA you will be assessed in accordance with the relevant training organisations standards. Purchase of training does not guarantee successful completion of the course. All examinations must be completed to the satisfaction of the awarding body;

Students who are unfit to attend training days due to the effects of alcohol or drugs will lose that training day; no refunds will be given;

Abuse of ADA Instructors is not tolerated in any form. Students who are abusive to ADA Instructors or visiting speakers will be removed from the class and will lose that training day with no refund being given. If the student continues to be abusive, they will be removed from the course of training and no refund will be issued;

By accepting the terms and conditions for website enrolement you are deemed to have accpeted the contents of this Learner's Agreement.  This constitutes a formal agreement between the student and the ADA and may be amended by additional signed papers if necessary. Where possible, ADA students will sign a copy of this learning agreement as soon as possible after starting their chosen course.
